Terms & Conditions

These Terms & Conditions outline the policies that apply to orders and products offered by Marley’s Treats & Sweets (“Marley’s”). By placing an order, submitting an inquiry, or purchasing products, you acknowledge and agree to the terms below.

Our goal is to provide a smooth, thoughtful experience while delivering products that are carefully prepared and packaged with attention to quality.

Orders

Orders may be placed through approved ordering methods, including direct communication, website inquiries, or online purchasing platforms.

All orders are subject to availability. As a small-batch business, Marley’s Treats & Sweets may limit quantities or decline orders based on ingredient availability or production capacity.

Marley’s Treats & Sweets reserves the right to refuse or cancel any order at its discretion, including but not limited to situations involving suspected fraud, misuse of services, or product availability limitations.

Pricing

Prices may change from time to time due to fluctuations in ingredient costs and sourcing. Once an order has been placed and payment has been received, the confirmed price will always be honored for that order.

In the event of a pricing, description, or availability error, Marley’s Treats & Sweets reserves the right to correct the error and cancel or adjust orders as necessary, with notice provided to the customer.

Payment

Full payment is required at the time an order is placed. Orders are not processed or prepared until payment has been received in full.

By completing a purchase, the customer agrees not to initiate chargebacks or payment disputes without first contacting Marley’s Treats & Sweets to resolve the matter. Unauthorized chargebacks may be contested with documentation confirming order fulfillment.

Order Changes

Because each order is prepared in small batches, changes may not be possible once production has begun.

If you need to make an adjustment, please reach out as soon as possible. While we will always try to accommodate requests made before preparation begins, changes cannot be guaranteed.

All Sales Final

Because our products are food items prepared in small batches, all sales are considered final.

If there is ever an issue with your order, we encourage you to reach out. While we are not able to offer returns, exchanges, or cancellations once an order has been placed, we will always do our best to listen and support where we can.

Shipping & Pickup

Orders may be fulfilled through local pickup or shipping, depending on availability and your selection at checkout.

We take great care in preparing and packaging each order so it arrives safely and in excellent condition. Please ensure that all delivery and shipping information is accurate at the time of purchase.

Once an order has been shipped or picked up, responsibility for the package transfers to the customer. 

While we carefully package each order, shipping carriers operate independently, and delays, damage, or delivery issues may occasionally occur.

If an order is delayed, mishandled, or damaged during transit, we encourage you to reach out so we can support you as best we can. While Marley’s Treats & Sweets cannot guarantee carrier performance or assume responsibility for issues outside of our control, we will always do our best to help guide you toward a resolution when possible.

If an order is returned, delayed, or undeliverable due to incorrect or incomplete shipping information provided by the customer, additional shipping fees may apply to resend the package.

Product Nature Disclaimer

Marley’s Treats & Sweets specializes in freeze-dried food products. Freeze-drying is a unique preservation process that changes the texture and structure of food.

As a result, products may vary slightly in size, shape, color, and appearance. These natural variations are part of the process and do not indicate a defect. Product appearance may differ from photographs or previous batches.

Storage & Freshness

Freeze-dried products are shelf-stable when stored properly.

For best quality, products should be kept in a cool, dry place and stored in their original sealed packaging or in an airtight container once opened.

Because freeze-dried foods are highly sensitive to moisture, exposure to air or humidity may cause them to soften or lose their crisp texture over time. Once opened, products are best enjoyed promptly.

While freeze-dried products have an extended shelf life when properly stored, Marley’s Treats & Sweets does not guarantee a specific shelf life once packaging has been opened.

Heat & Environmental Conditions

Freeze-dried products are generally stable; however, they can still be affected by environmental conditions.

Exposure to heat, humidity, or temperature fluctuations during shipping, delivery, or storage may affect texture, appearance, or overall quality. For example, high humidity may cause products to soften, and excessive heat may impact certain ingredients, particularly chocolate or coated items.

We take care to package products thoughtfully to help protect them during transit. However, because shipping and storage conditions can vary and are outside of our control once an order leaves our hands, we are not able to guarantee product condition if exposure occurs.

If you have any concerns about your order upon arrival, we always welcome you to reach out so we can assist where possible.

Allergen Information

IMPORTANT NOTICE
MARLEY’S TREATS & SWEETS IS NOT A NUT-FREE KITCHEN.

Products are prepared in a kitchen where common allergens, including peanuts, tree nuts, dairy, gluten, eggs, and soy, may be present.

While care is taken during preparation, cross-contact may occur. Marley’s Treats & Sweets cannot guarantee that any product is completely free from allergens.

In addition, many of the items used in our freeze-dried products, including candies and other ingredients, are sourced from third-party manufacturers. Marley’s Treats & Sweets relies on supplier-provided information and cannot control or verify manufacturing conditions at those facilities. As a result, we cannot guarantee that these products were produced in allergen-free environments or that cross-contamination did not occur prior to our use.

If you or someone consuming these products has a food allergy or sensitivity, we strongly recommend reviewing ingredient labels when available and exercising appropriate caution.

Individuals with severe food allergies are advised not to consume products prepared in our kitchen or sourced through third-party suppliers.

By purchasing or consuming products from Marley’s Treats & Sweets, you acknowledge and accept these risks.

Limitation of Liability

Marley’s Treats & Sweets takes great care in preparing and packaging each product with quality and attention to detail.

However, we are not responsible for any adverse reactions, damages, or losses resulting from the consumption, handling, delivery, or use of our products once they have been received.

Customers are responsible for determining whether products are appropriate for their individual dietary needs and for communicating any allergen considerations to others who may consume them.

By purchasing from Marley’s Treats & Sweets, you acknowledge and accept these responsibilities.

Force Majeure

Marley’s Treats & Sweets is not responsible for delays or inability to fulfill orders due to circumstances beyond reasonable control. These may include severe weather, supply disruptions, transportation issues, power outages, or other unforeseen events.

If such situations arise, we will make every reasonable effort to communicate and provide an appropriate solution whenever possible.

Governing Law

These Terms & Conditions are governed by the laws of the State of Tennessee.

Brand & Content

All branding, product designs, images, and written content associated with Marley’s Treats & Sweets are the property of Marley’s and may not be copied, reproduced, distributed, or used without prior written permission.

Products purchased from Marley’s Treats & Sweets are intended for personal use or gifting and may not be resold without prior written permission.

Updates to These Terms

Marley’s Treats & Sweets may update these Terms & Conditions from time to time. The most current version will always be available with the updated effective date.
